Am I safe if I classify workers with immigration problems as Independent Contractors? |

No, in fact that Employer may be in even more trouble. Some Employers erroneously think that by classifying or converting their workers with immigration problems as Independent Contractors, or that by taking them off payroll, that they are safe. Unfortunately, those Employers who do so are now subject to additional penalties from the Internal Revenue Service and the EDD for failure to properly report and pay payroll taxes and to match Social Security taxes for those workers.
