What if I suspect a key employee is an illegal alien? |

It is our opinion that the investigation should not be performed by the Employer, but rather by an attorney. Such an investigation, which of necessity requires that the employee provide additional information is a landmine of potential liability to the Employer. The Employer risks crossing the line into discrimination based upon such issues as race or Natural Origin. Additionally, the Employer cannot easily interpret if an employee has proper work authorization from the Immigration authorities to work.
