What should I do I receive a letter from the Social Security Administration?
It is our advice that letters from the Social Security Administration stating that the Social Security Number of an employee does not agree with their records be turned over to an attorney for handling. These letters are referred to as Social Security Mismatch Letters and they should not be ignored. They do not in and of themselves put the Employer on notice that an employee is an illegal alien or not otherwise entitled to work. However, if the investigation is not properly handled it may result in additional problems to the Employer. Therefore, if you have received any Social Security Mismatch Letters, you should seek legal advice immediately. If you have received multiple Social Security Mismatch letters, you may have a major problem and should consult an attorney immediately.
In either case, the proper gathering, interpretation and pursuit of remedial action is something that only an attorney knowledgeable in this are of the law should perform, not the Employer or the Human Resources Department.
