Employers are AT RISK whenever they hire a foreign national. Under current Immigration Laws, most notably IRCA, Employers are subject to both civil and criminal penalties if an employer hires a person who is not authorized to work in the United States. The government is expected to become very pro-active in 2006 in seeking out Employers who have unauthorized aliens working for them, whether on or off the payroll.
